KRIZA VLADAVINE PRAVA U EVROPSKOJ UNIJI / CRISIS OF THE RULE OF LAW IN THE EUROPEAN UNION

Abstract

The European Union as a political and legal creation has a serious problem of establishing a democratic order of the rule of law on its entire territory. On the part of European officials, there are serious attempts to overcome the problem of the democratic rule of law, and the main obstacles on the way are the transition processes in certain member countries, the high rate of voter abstention in the countries of the European Union, the failure of negotiations regarding the introduction of the European Union constitution, democratic deficit, which contributes to the strengthening of federalism, as well as inconsistency in the application of democratic principles in all European states. The crisis of the rule of law in the European Union aims to make room for some other, unwanted political models. We are witnessing the strengthening of nationalism and nationalist parties and movements throughout the European Union. In a large number of European Union countries, leaders and parties with a pronounced right-wing background come to power, and we have the latest example in Italy, where Giorgia Meloni, known for her radical right-wing views, was elected prime minister.
