PRAVEDAN RAT: BOSNA I HERCEGOVINA / JUST WAR : BOSNIA AND HERZEGOVINA

Abstract

The war could only be justified like of „self-defence“. In practice we have: pro-democratic intervention, intervention to protect own citizens and humanitarian intervention. When the state can convince the Interntional community that the war is only choice for defence own citizens and theritory this war is the „justice war“. Just-war theory, or the application of the principles of justice to warfare, has a long history. But the essential questions that the theory addresses are: When is going to war just? And how can war be waged justly? The principles of jus ad bellum require that a nation have just cause and right intention in declaring war, that the declaration be openly and properly declared, and that there be some reasonable expectation of winning the war. However, justice forbids the initiation of force, acts of aggression cannot be morally justified.
