Abstract

The carrier's liability for damage to goods in road transport arises from the contract of carriage concluded with the person ordering the carriage. The form and type of that responsibility is defined by the applicable regulations for this type of transport, i.e. the regulations governing the corresponding contract of carriage. If during transportation there is damage to the goods for which the carrier is responsible, he will have to compensate for such damage. Bearing in mind a wide range of transport risks that can lead to damage to the goods, on the one hand, as well as a high amount of damage on the other hand. Carriers can protect their economic interest by contracting insurance. By signing insurance against liability for damage to the goods they transport, carriers protect their interest in such a way that the damage for which they are responsible should be compensated by the insurance company instead of them. The aim of the work is to point out in one place the problem of the responsibility of the carrier in road traffic from the aspect of current legal regulations, as well as the very important role of insurance of the responsibility of the carrier. In the conclusion, a brief description of the observed problems in the existing legal regulation of the observed problem is given, as well as the possibilities of providing adequate protection of the carrier through the contracting of insurance coverage.
