Abstract

The process of integration with the European Union is conditioned by the fulfillment of certain obligations. EU Member States are required to apply the European Convention on Human Rights and Fundamental Freedoms. Therefore, EU Member States and countries that wish to join the European Union must ensure respect for the rights enshrined in the European Convention on Human Rights and Fundamental Freedoms. Bearing in mind that Bosnia and Herzegovina has signed and ratified the European Convention on Human Rights and Fundamental Freedoms in its legal system, thereby it has also committed itself to the protection of rights deriving from the Convention. This proves the readiness to apply the rules adopted in the domestic legal system that are also a part of the obligation for the countries that want to join the European Union. This paper will point out the importance of applying the European Convention on Human Rights and Fundamental Freedoms with an accent on trial within a reasonable time. In the context of the right to a trial within a reasonable time, the consequences of a violation of this right will also be pointed out.
