VLADAVINA PRAVA KAO PREDUSLOV EU INTEGRACIJA/RULE OF LAW AS A PREREQUISITE FOR EU INTEGRATION

Abstract

The rule of law is one of the fundamental values of the European Union and a prerequisite for ensuring the protection of fundamental rights. The concept of the rule of law forms the basis of the democratic system in all Member States and is crucial for the functioning of democratic societies. Rule of law means that all public authorities always act within the limits established by law, in accordance with the highest values of democracy and fundamental rights, and under the control of independent courts. The rule of law always implies a power based and limited by law, which secures and guarantees individual rights. An effective judiciary is a prerequisite for the realization of the political and legal ideals on which the EU is based - the ideal of the rule of law. The concept of the rule of law in the EU enables the judicial protection of individuals against the arbitrariness of government institutions. The rule of law is a headstone of all democratic societies and, as such is part of the acquis communautaire of the European Union, and it cannot be negotiated. Bosnia and Herzegovina is no exception in this regard, and strengthening the rule of law is a multi-generational task for Bosnia and Herzegovina. Strengthening the rule of law is one of the preconditions for EU integration, but also for the economic strengthening of Bosnia and Herzegovina
