PRIMJENA CARINSKIH PROPISA EVROPSKE UNIJE / APPLICATION OF THE CUSTOMS REGULATIONS OF THE EUROPEAN UNION

Abstract

: With this text, we would like to highlight some legal aspects of the application of customs regulations of the Union, which may be of interest to the states which claim to become its members. Namely, by admission in membership to the European Union, each country must adapt customs legislation in the field of customs operations to the customs legislation of the Union, and each of them usually introduces a special law on the implementation (or application of) customs regulations of the Union. In the legislation of the Member States which is concerning the application of the customs regulations of the Union, the collection of public goods for imported, exported or transported goods is usually regulated, electronic data exchange and reporting, the scope of application and basic terms of reference. However, it is important to know that Member States remains authorization to regulate certain matters in the field of customs legislation under national legislation which are not regulated by the Union. Besides of this, we have given some more important remarks regarding the New Customs Legislation of the European Union and have provided a more stringent set of regulations and other regulations to amend, supplement or replace them. Also, the customs regulations of the Union shall also include all other rules governing in any way the customs treatment of imported, transported or exported goods from the Union, or goods which are subject to the single regulations, the customs tariff and the customs procedures.
