Abstract

The goal of the present study is to draw attention to the need to establish public corporations of interest to the state of Bosnia and Herzegovina as a whole, as provided for in Annex 9 to the General Framework Agreement for Peace in Bosnia and Herzegovina (known as the Dayton Peace Agreement), in particular in the energy and transport. Unfortunately, these problems are not legally regulated at the state level because there is no law on public corporations nor the responsible ministry to implement the same rules. This paper will specifically analyze the legal and political obstacles in the organization and functioning of the common koroporacija of interest for Bosnia and Herzegovina, keeping in mind the complexity of the constitutional order.
