The first decade of the XXI century is marked by strengthening of extremism and radicalism, as well as the emergence of large number of organization that tend to this kind of behaviour. In these conditions, the very nature and the understanding of the role and the concept of the sovereign state, as well as the importance it has for the construction of the world. More than ever, there is a need for cooperation between the international community on the one hand and sovereign states on the other hand. In the changed security conditions, which necessarily leads to the rearrangement of international legal standards in order to respond to new global challenges in the right way. So most of the countries affected by violent extremism adapt their criminal codes towards new challenges, taking into account global projects and UN documents which contain recommendations and proposals. In this context, new legal norms are being created or complementing the existing. Since the phenomenon of departure of foreign fighters has not bypassed Bosnia and Herzegovina, the Parliamentary Assembly of Bosna and Herzegovina adopted in 2014 the Law on Amendments to the Criminal Code of Bosnia and Herzegovina, which supplemented the Article 162, Paragraph b). The purpose of this paper is, by using the theoretical and positive legal methods, examine the correlation between the law and the new security context, with particular reference to the already mentioned provision of the Criminal Code of Bosnia and Herzegovina; while the importance of research results are reflected in the contribution as part of the recommendations for the creation of legal and other initiatives that contribute to safe and secure environment in BiH
