Abstract

Starting from the definition of credit in theory, certain questions are raised. First of all, in addition to other rights and obligations arising in such a legal relationship, there is also the issue of ensuring the repayment of credit funds. In this context, the question arises: "Which means of loan security to choose", ie which means of loan security are considered by the contracting parties as adequate insurance in that particular legal relationship. In the present context, the authors will refer to, in addition to the credit agreement, also to the loan agreement, and the research is based on the lien on real estate, as a means of securing the return of credit funds. In addition, in the legal relationship of exercising the rights from the loan agreement, this paper partly explores the procedure of forced collection in terms of the applicable law on enforcement proceedings.
