ANALIZA PROPISA KOJI REGULIŠU DRUMSKI PREVOZ OPASNIH MATERIJA U BiH/ANALYSIS OF REGULATIONS REGARDING ROAD TRANSPORT OF DANGEROUS MATTERS IN BiH

Abstract

One of the core elements of the rule of law is the existence of laws that are specific, public and just, while their application must never be retroactive. In Bosnia and Herzegovina, laws are made, depending on the area, on entity level, Brčko district, canton, or on BiH state level. The thesis deals with a survey of the state of laws and regulations, including international agreements, concerning the road transport of dangerous materials in BiH. During the research, cases of differing regulations within the territory of BiH were found, as well as inconsistencies of those regulations with international agreements signed by BiH. For legal security to exist, it is necessary for regulations in a given area be equal, or at least harmonized. In this thesis, inconsistencies in “European road transport of dangerous materials agreement” (“Accord européen relatif au transport international des marchandises dangereuses par route”, or ADR for short) were found, and current entity and Brčko district laws were analyzed. Some laws yet to be passed are considered too. With all that, analysis is given and solutions are proposed, all with the goal of having better legal solutions and improving the rule of law in this country.
