Abstract

This paper describes the problems encountered during the Prosecution's investigation regarding the surveillance and technical recording of telecommunications in conjunction with Article 130, item 2 a) of the CPC of FBiH, and where through a large number of evidentiary evidence of the reproduction of the call is detected a violation privacy rights. Differences in the content of conversations that are not relevant to the criminal proceedings have been noted and are reproduced, and thus other persons who are not subject to criminal proceedings are denied the right to privacy, that is, violations of fundamental human rights and freedoms.
