The key causes of traffic accidents in the traffic reports are improper speed and speed unsuitable for driving conditions, driving under the influence of alcohol, not using the seat belt, and failing to comply with the traffic regulations. Namely, the results of the research have had an increasing effect of distraction, or distraction of driving drivers, most often due to the use of mobile phones during driving. In addition to this problem experts warn that other forms of distraction, such as eating, drinking, smoking, talking to the passengers in the car, are happening during the drive, but none is pernicious for driving safety, such as using a cell phone. Cell phone talk and vehicle management are two demanding activities, with means that high – quality conversation and vehicle management requires a mediocre understanding, so it is clear that these two activities are hindering. The results of the research of this problem in the paper have the purpose of considering the impact of the use of the mobile phone on the safety of driving and the suggestions of its solution. Existing legal solutions governing the use of mobile phones during the journey should be reviewed and in accordance with the results of the research and good practice, define a new one that will affect the improvement of driving safety.
